By accessing, browsing, or using our Website and/or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree to these Terms, please do not access or use our Website or Services.

These Terms apply to all users of our Website and Services, including but not limited to browsers, vendors, customers, merchants, and content contributors.

2. Use License

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Website and Services for lawful purposes only. This license does not include:

You may not reproduce, distribute, transmit, modify, adapt, translate, or create derivative works based on any of our content without our prior written permission.

3. Translation Services

3.1 Service Description

Verity provides professional certified translation services for various document types, including but not limited to immigration documents, legal documents, academic records, medical records, court certifications, business documents, and personal documents. Our translators are trained, qualified, and certified professionals. All translations are performed in compliance with industry standards and applicable regulations.

3.2 Service Process

  1. Quote Request: You submit information about your translation needs
  2. Quote Provision: We provide a written quote with estimated cost and timeline
  3. Order Acceptance: Upon your acceptance and payment, we begin the translation process
  4. Translation: Our professional translators complete the translation
  5. Quality Assurance: Our team reviews the translation for accuracy and quality
  6. Delivery: The completed translation is delivered via your chosen method

3.3 Accuracy and Quality

We employ qualified translators and quality assurance processes to ensure accurate translations. However, we cannot guarantee that all translations will be 100% perfect, as translation involves interpretation and professional judgment. You understand that translation is subjective and may involve multiple valid interpretations.

3.4 Turnaround Times

Estimated turnaround times are provided as guidelines based on document length, complexity, and current workload. While we strive to meet these estimates, we do not guarantee specific delivery dates unless expressly agreed to in writing with express fees.

4. Pricing and Payment

4.1 Pricing

Our pricing is based on document word count, complexity and specialization, required turnaround time, language pair, certification requirements, and additional services requested. Pricing is provided in a written quote before work begins.

4.2 Payment Terms

  • Payment is due in full before translation work begins
  • We accept payment via credit card, wire transfer, and other methods specified on our Website
  • Invoices must be paid according to the terms specified in the invoice
  • Late payments may result in service suspension or account termination

4.3 Refunds and Cancellations

Cancellation Policy:

  • Cancellations requested before translation work begins: Full refund minus a 15% cancellation fee
  • Cancellations after work has begun: Non-refundable; you will be charged for work completed
  • Cancellations after translation is complete: No refund
  • Express orders are non-refundable if work has commenced

Refund Policy:

  • Refunds for defective work may be provided if we agree that the translation is materially defective
  • Refunds will be issued within 14 business days of approval
  • Requests for refunds must be submitted within 30 days of delivery

5. Confidentiality and Document Handling

5.1 Confidentiality

Verity understands that translation services often involve confidential and sensitive information. We are committed to protecting the confidentiality of your documents. Your documents are treated as strictly confidential, access is limited to authorized personnel only, and your documents will not be shared with third parties without your consent.

5.2 Document Storage and Retention

  • Original documents are retained for 30 days after project completion unless otherwise arranged
  • Digital copies may be retained for quality assurance purposes for up to 90 days
  • Upon request, all documents will be securely deleted
  • You may request extended storage for an additional fee

5.3 Document Destruction

Upon project completion and expiration of the retention period, physical documents are securely destroyed or incinerated, digital files are permanently deleted using industry-standard methods, and we do not retain copies of your documents after the retention period without your permission.

6. User Responsibilities

6.1 Account Creation

If you create an account on our Website, you agree to provide accurate, current, and complete information, maintain the confidentiality of your account credentials, accept responsibility for all activities that occur under your account, and notify us immediately of any unauthorized access or use of your account.

6.2 User Content

You are responsible for any content, documents, or information you submit to us. You represent and warrant that you own or have the right to use all submitted content, the content does not infringe on any third-party intellectual property rights, and the content is not defamatory, obscene, or unlawful.

6.3 Prohibited Content

You agree not to submit content that violates any law or regulation, counterfeit or fraudulent documents, content that infringes on intellectual property rights, obscene, abusive, or defamatory content, or content intended to facilitate fraud, hacking, or other illegal activities.

7. Limitation of Liability

7.1 Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VERITY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.

7.3 Liability Cap

EXCEPT WHERE PROHIBITED BY LAW, VERITY'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN QUESTION, OR $100, WHICHEVER IS LESS.

8. Indemnification

You agree to indemnify, defend, and hold harmless Verity Translation Services and its officers, directors, employees, agents, and successors from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of our Website or Services, your violation of these Terms, your violation of any applicable law or regulation, your infringement of any third-party intellectual property rights, or any dispute between you and a third party.

9. Dispute Resolution

9.1 Informal Resolution

Before initiating formal proceedings, we encourage you to contact us to attempt to resolve any dispute informally. Please contact us at support@veritytranslate.com or (253) 214-9009. We will attempt to resolve the dispute within 30 days of your contact.

9.2 Binding Arbitration

If informal resolution fails, you agree that any dispute arising from or related to these Terms or our Services shall be resolved through binding arbitration. Arbitration shall be conducted in Spokane, Washington, and a single arbitrator shall be selected in accordance with the American Arbitration Association (AAA) rules.

9.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, class arbitration, or representative action.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

11. Modification of Terms

We may modify these Terms at any time, in our sole discretion. We will notify you of material changes by posting the revised Terms on our Website and updating the "Last Updated" date. Your continued use of our Website or Services following the posting of modified Terms constitutes your acceptance of the changes.

12. Termination

12.1 Termination by You

You may terminate your use of our Website and Services at any time by ceasing to use them. Any pending orders will be processed according to these Terms unless you cancel before work begins.

12.2 Termination by Verity

We may terminate or suspend your account and/or access to our Services, in our sole discretion, without notice or liability, for violation of these Terms, violation of any applicable law or regulation, non-payment of fees, abusive or threatening behavior, or any reason or no reason.

13. Certifications and Credentials

13.1 Translator Qualifications

All translations performed by Verity are completed by qualified professional translators who are native or fluent speakers of both source and target languages, subject matter experts in relevant fields, trained in professional translation standards, and committed to accuracy and quality.

13.2 Certified Translations

We offer certified translations in accordance with applicable regulations. Certified translations include an affidavit from our translator certifying that the translation is accurate and complete, the translator is qualified to perform the translation, and the translation was completed on a specific date.

13.3 No Legal Advice

Translation services do not constitute legal advice. We do not provide legal interpretation or analysis of translated documents. If you require legal advice regarding translated documents, you should consult with a qualified attorney.

14. Third-Party Links and Services

Our Website may contain links to third-party websites, applications, and services that are not operated by Verity. We are not responsible for the content, accuracy, or availability of third-party websites, the practices or policies of third-party operators, any transactions you conduct with third parties, or any losses or damages resulting from your use of third-party services. We encourage you to review the terms of service and privacy policies of any third-party websites or services before using them.
